What do you think?
Everybody knows that flying insects are attracted to light. They annoy us to no end as they buzz around and crash into our light fixtures over and over and over again. Thankfully, they leave after the lights are off.
But what if they don’t? What if they decide that your light fixtures are where they want to stay for good? That’s the dilemma a couple we’ll call Dave and Donna faced in their first year of new home ownership. Somehow, small insects were able to crawl into the fixture itself, and remain there long after their own little lights went out.
Dave and Donna’s view was that this unsightly occurrence was due to a defect in their light fixture and that it would be covered by their new home warranty. When their builder did not agree, the couple decided to include it on their year-end warranty form and ask Tarion to step in.
How would you decide? Is it warranted or not warranted?
