Earlier this week, we showed you a crack running along a basement concrete floor that was damp in places and asked if you thought it was something that would be covered under the warranty.
To help us out with the answer, we asked two of our resident experts on warranty matters, Dan and Bob.
Dan: “I’m going to have to agree with the builder on this one. This is a case of dampness, likely caused by moisture from beneath the concrete slab. It is definitely not an example of water penetration, because water is not pooling on the ground. Article 1.14 of the Construction Performance Guidelines states that ‘Only actual water leakage through the floor slab resulting in accumulation of water is warranted; dampness or condensation is not considered a warranted condition.’ If the homeowner is not comfortable with seeing the dampness, they should take measures to seal the crack.”
Bob: “I agree. In this case it’s possible the dampness is the result of a temporarily high water table, something that can occur after a heavy snow melt or after a prolonged heavy rainfall. For me, the key takeaway here is that the warranty is very specific about only covering water penetration through the floor slab when it results in the accumulation of water.”
Answer: Not Warranted.
